Stall seller terms
Version 2026-11-01 · last updated 1 November 2026
These terms are the agreement between you and twirlr when you sell on the Stall, twirlr’s marketplace for dance kit in the twirlr app. They apply on top of the twirlr Terms and conditions (twirlr.app/legal/terms). Our Privacy notice explains how we use your details.
Please read them before you ask to open a stall. You accept them in the app before your stall can be approved.
1. Who this is for
twirlr is run by RTA Twirling & Events Ltd, a company registered in England and Wales (number 17174281), 128 City Road, London EC1V 2NX. In these terms "twirlr", "we" and "us" mean that company. "You" means the seller: the person or company that runs a stall. "Buyer" means someone who orders from your stall.
- The Stall is for approved sellers only. You ask to open a stall in the app, and twirlr decides whether to approve it.
- You must be 18 or over. If you sell for a company, you confirm you are allowed to accept these terms for it, and the company is the seller.
- The Stall is for dance: kit, costumes, shoes, batons, poms and other things dancers use.
2. You are the seller
When a buyer orders from your stall, the contract of sale is between the buyer and you. You are the seller of record. twirlr is not the seller, does not own the goods and is not a party to that contract. twirlr runs the marketplace: the listing pages, the checkout, and the order, return and contact screens in the app.
Every listing, the basket, the checkout and the buyer’s orders show "Sold by" with your stall’s name, so buyers know who they are buying from.
3. Business seller or private seller
When you sign up, you tell us which you are. The Stall shows it as a badge (Business seller or Private seller) on every listing, the basket, the checkout and orders.
- Business seller: you sell as a trade or business. That includes selling for a company, making or buying things to sell, or selling regularly to make money. Consumer law treats you as a "trader", and buyers have their full consumer rights against you.
- Private seller: you are a private person selling your own things now and then, such as outgrown kit or a costume your dancer no longer needs. Buyers have fewer rights against a private seller (the goods must still be as described), and we tell them what the badge means.
Choose honestly. If you sell as a business, you must not call yourself a private seller. Declaring falsely, for example to avoid giving buyers their consumer rights, breaks these terms and may break the law, and we may change your badge, pause your stall or close it (section 9).
If things change, for example your selling grows into a business, update it in Stall settings straight away.
4. UK sellers only
For now you must be based in the UK, and the bank account your money is paid into must be a UK account. This is because, under VAT law, sales by sellers outside the UK would make twirlr responsible for the VAT on them. If you move outside the UK, tell us and we will pause your stall.
5. Your details and reporting to HMRC
To open a stall we ask for: your trading name; whether you are a business or private seller; whether you sell as an individual or a company; your legal name; your address; your email and, if you choose, a phone number; your date of birth (individuals); your company number (companies); your National Insurance number or Unique Taxpayer Reference (individuals; companies may give a UTR); your VAT number if you are registered; and the country of your bank account.
- Why: the law requires us to collect and check these details, under The Reporting Platform Operators (Due Diligence and Reporting Requirements) Regulations 2023, and we need them to run your stall under these terms.
- Who sees them: they are kept in a restricted record that only you and twirlr platform staff can read. Associations and the public never see them, apart from the details in the next point.
- Business sellers: the law requires a trader to tell buyers who they are, so your shop page shows your trading name, your geographic address, your company number and VAT number if you have them, and your email (and phone, if you gave one). Private sellers’ addresses are not shown; buyers contact you through twirlr.
- Reporting to HMRC: each January we report to HMRC the details of sellers who, in the calendar year before, made 30 or more sales or received about €2,000 or more, with what they received and the fees we took. HMRC may share this with other countries’ tax authorities. Before the report goes in, we send you the information about you that we report.
- How long: we keep these details for six years after the end of the year they relate to, as the 2023 Regulations require, even after your stall closes.
- Your copy: your seller details are in your twirlr data export (Settings, Your data). Keep them up to date in Stall settings.
If you do not give the details we need, or they do not check out, we cannot approve your stall, and we may have to pause it or hold your money until they are put right, as the Regulations require.
6. Your responsibilities as the seller
- Descriptions and photos: describe what you sell accurately, with real photos of the item (or of the exact product), its size, whether it is new or used, any faults, and what is included.
- Price: show the full price of the item, including VAT if you charge it, and your delivery costs. twirlr adds its £1 order fee at checkout (section 7).
- Delivery: send the order to the address the buyer gave, within the time you show, and add tracking when you can. The goods are your responsibility until they reach the buyer.
- Returns, refunds and faults: you handle them, answering in the app from the order. Business sellers must give buyers their rights under the Consumer Rights Act 2015: goods must be of satisfactory quality, fit for purpose and as described; a buyer can reject faulty goods for a full refund within 30 days; after that you repair or replace them, and if that fails, refund.
- Cancellation: business sellers must let buyers cancel within 14 days of the goods arriving, without a reason, under the Consumer Contracts Regulations 2013, and refund within 14 days of getting the goods back (or proof they were sent). Made to measure and personalised items do not have this right: label them clearly as made to measure or personalised on the listing.
- Information the law requires: business sellers must tell buyers, before they buy, who you are, your geographic address and contact details, the total price including taxes, delivery costs, and their right to cancel. Fill in Stall settings fully so your shop page and listings carry it.
- Safety: everything you sell must be safe and meet the law, including the General Product Safety Regulations 2005 and any rules for that kind of product (for example UKCA or CE marking where it is needed). Do not sell recalled items. If you learn an item is unsafe, take it down at once and tell us and your buyers.
- Tax: you are responsible for your own income tax, VAT and any other tax on your sales.
- Buyers’ details: use a buyer’s name and address only to send and deal with their order, and keep them safe. For those details you are a separate controller under data protection law.
- Private sellers: you must still describe items honestly, send what you sold, and answer buyers in the app.
7. Fees and payouts
- There is no listing fee. There is a monthly shop plan of £9.99, a subscription billed to your card, never taken from your sales or payouts. Shops that sign up before the Stall launches pay no subscription for the first 12 months. Until twirlr’s own payments go live, nobody is charged for it.
- twirlr’s Stall fee is 7% of the item price plus £1 per order. Card processing is included.
- You choose in Stall settings who pays the 7%: you (taken from your payout), the buyer (built into the price shown on your listing), or split between you.
- The £1 per order is always paid by the buyer, and is shown from the product page onwards.
- How payments work: you connect your own Stripe account. Each order is charged on your Stripe account (a "direct charge"), so the money is yours from the start, and twirlr’s fee is taken at the same time as an application fee. Stripe’s own terms for connected accounts apply between you and Stripe. twirlr does not hold your money.
- When you are paid: free, every day. Each order is paid out from your Stripe balance to your UK bank account 5 days after it is delivered. An order with a return asked for or open is paid once the return is settled. The Stall manager in the app shows what is ready, what is on the way and the day each order pays out, and a statement for every payout with each fee on its own line.
- Instant payout (optional, when we offer it to your stall): you can ask to be paid on delivery instead of after 5 days, for a fee of 2% of the payout, at least £1. The free payout stays the default. You choose it each time, after the app shows the fee and what you will get in pounds, or you turn on "Always pay me instantly", which you can turn off at any time. We offer it only to stalls in good standing (for example enough delivered orders, a low return rate and no open payment dispute), never on an order with a return asked for or open, never on made to measure items, and up to a daily limit. We may change these limits or stop offering it; the free payout is not affected.
- Refunds after a payout: if you refund an order after it was paid out, the amount comes off your next payout first. If your payouts do not cover it, Stripe takes it from your Stripe balance, and then from your bank account, under Stripe’s terms.
- What we tell you: we email a remittance for each payout (the amount, any fee, anything taken for an earlier refund and the orders it covers), and we tell you in the app and by email if a payout does not reach your bank. The money is not lost: it goes in the next payout once your bank details are right. We tell you when a buyer’s bank opens or closes a dispute on an order; you answer it in your Stripe dashboard, and instant payouts wait while it is open. If you refund a buyer from your Stripe dashboard instead of twirlr, we record it on the order and tell the buyer.
- Today the only open shop on the Stall is the twirlr test shop, run by twirlr itself, and its payments are taken by twirlr. Payments and payouts for other sellers start only once twirlr’s payments go live and your Stripe account is connected.
7a. Your shop plan
- Each stall has a monthly shop plan of £9.99, on top of the Stall fee. It is a subscription billed to your card by Stripe on twirlr’s behalf, with its own invoice and receipt. It is never taken from your sales or your payouts.
- Founding shops: sign up your shop before the Stall launches and you pay no subscription for the first 12 months. Every stall that applies before the launch date is a founding shop, with no limit on how many. The launch date is not set yet; until it is, every stall that applies qualifies, and once it is set we show it on twirlr.app/stall before it applies. A founding shop’s plan starts with a free trial of 12 months from the day the stall is approved and goes live: nothing is charged until then, and the Stall manager shows the date the free months end. We ask for a card before then, and remind you by notification and email 30 days before they end. If no card has been added when they end, your stall is paused: your products are hidden from buyers and nothing is deleted. Add a card and it opens again. twirlr may also make a stall a founding shop by hand.
- Other stalls (applied on or after the launch date): the plan starts when your stall is approved, and your stall goes live once a card is added.
- Cancel any time: in the Stall manager, Payouts, Shop plan, one tap. Your plan runs to the end of the month you have paid for, then stops; you are not charged again. Cancelling is as easy as signing up. While your plan is cancelled or a payment has not gone through, we may pause your stall (products hidden, orders already placed still need you), and we tell you first.
- Price changes: we will tell you at least 30 days before any change to the price of the plan, and you can cancel before it applies.
- The shop plan is a business service between you and twirlr. Plan payments are not live yet: until twirlr’s own payments go live nobody is charged and no stall is paused for the plan.
7a. Pitches at associations’ events
- Associations on twirlr can offer stall pitches at their competitions. You can ask for one in Your stall, Events. Your contract for the pitch is with the association: it decides whether to approve you, gives you a pitch number and set-up time, and can cancel a pitch.
- When you ask, the association sees your stall’s trading name, logo, contact email and phone, your note and the products you say you are bringing. It may contact you about the event. It is a separate controller for those details and uses them only for its event.
- An approved pitch is yours once paid (a free pitch is confirmed when approved). You pay the association through twirlr; twirlr adds its booking fee (5% of the pitch price plus £1, shown before you pay) unless the association is exempt. A refund of a pitch is the association’s to give.
- You can withdraw a request, or an approved pitch you have not paid for. Families going to the event see your stall’s name, logo and pitch.
7a. Promotions (optional)
- You can pay to show one of your products first: at the top of For you, of its category, or of an event’s kit list. Promotions are optional and you choose each one in Promote, in your Stall manager or seller console, where you see the price before you confirm.
- Pay per tap: you set a daily budget (at least the minimum shown, £1 a day today) and the days it runs. You pay the price per tap shown when you set it up, only for taps, and never more than your daily budget on any day. A tap is charged once per person per day, never for you or your team, and taps twirlr finds unusual are not charged.
- Event boost: a flat price, shown before you confirm, for the top of one event’s kit list in the days before it (7 today). One stall per event. It is charged once, when it starts, and is not refunded if you stop it after that.
- How you pay: promotions are paid from your Stall earnings before they reach you, never by card. Each day’s spend is a line on your statement and comes off your next payout. When your earnings do not cover the next tap, the promotion pauses by itself and starts again when your next order is paid.
- Every promoted product is labelled Sponsored. Which promotion shows is a rotation between the stalls that paid for that place, never chosen from anything about the buyer. Under 16s never see promotions in their For you; they may see them in a category or an event’s kit list, labelled. Nothing shows on competition day.
- Only live dance products from approved stalls can be promoted, and every rule in section 9 applies to them. twirlr may stop any promotion that breaks these terms or our policies; we tell you why, and a promotion we stopped cannot be started again. Spend already made on taps is not refunded, unless we stopped it by mistake.
- You can pause or stop a promotion at any time; nothing is spent while it is paused. You see each promotion’s views, taps, sales after a tap and spend, as totals only, never who tapped.
- We tell you when a promotion ends, when an event boost is charged, and if twirlr stops one, with the reason.
- The prices may change. A change applies to promotions you set up after it; one already running keeps the price per tap it started with.
8. Refunds, disputes and buyer protection
- You decide returns and refunds within the law, and show your returns policy on your shop page. It must never give buyers less than the law does.
- Refunds come out of your Stripe balance. On a full refund, twirlr gives back its 7% and the £1. Stripe keeps its card fee on the payment, and that cost is yours.
- Chargebacks and disputes: if a buyer disputes a payment with their bank, the amount and Stripe’s dispute fee come out of your Stripe balance. Answer disputes quickly, with proof of delivery where you have it.
- Buyer protection: if you do not act on a return request or a "not received" report within 5 working days, twirlr may refund the buyer itself and recover the amount from your next payout or your Stripe balance.
- When you turn a return down, give the buyer a reason; they see it on their order. They can ask twirlr to look at it within 30 days. Once twirlr has stepped in, twirlr decides: you can still approve the return, but you cannot turn it down again.
8a. Shopify sync (optional, free)
If you run a shop on Shopify you can connect it to your stall, from the Stall manager in the app or the seller console. Connecting is up to you, costs nothing, and you can disconnect at any time. When you connect:
- What comes across: twirlr reads your Shopify products, photos, prices, options and stock, and brings them onto your stall as hidden drafts. You choose each product type’s Stall category, leave out anything that is not for dance (section 9), and put the drafts live yourself. Gift cards and downloads stay in Shopify. A was price is not brought across: on the Stall a was price needs 28 days at the old price.
- Staying in step: changes you make in Shopify (names, descriptions, prices, sizes, photos and stock at the location twirlr follows) reach your Stall listings by themselves. A product you archive or delete in Shopify comes off the Stall. Your Stall listings are still yours under these terms: you are responsible for what they say (section 6), wherever you edit them.
- Stall orders in your shop: each paid Stall order is put in your Shopify shop, marked "Paid on twirlr Stall", with the buyer’s name, the delivery address, what they bought and the prices (never their email, phone or card), and its stock is taken off, so you send it from one place and do not oversell. Shopify sends the buyer no emails about it. You can switch this off and have only the stock taken off.
- Payments and refunds: the buyer paid through twirlr, so never take payment for a Stall order in Shopify. A refund you make in Shopify on a Stall order is refunded to the buyer’s card through twirlr (a whole order, or exactly the items of an open return, at once; anything else asks you to press Refund on twirlr). Section 8 applies to it like any refund. A refund you make on twirlr is shown on the Shopify order too, with its stock put back when the items come back.
- Buyers’ details in Shopify: Shopify holds them for you, under your own agreement with Shopify. You remain the controller of them (section 6): use them only for the order, and delete them when you no longer need them.
- If the connection breaks (for example you remove the twirlr app in Shopify, or Shopify stops accepting the connection), twirlr tells you in the app and the seller console. Until you reconnect, keep your stock right on twirlr by hand. twirlr is not responsible for Shopify’s own service, or for stock sold twice while a connection you were told about stays broken.
- What we keep: your shop’s address and name, the encrypted connection key (deleted the moment you disconnect), your choices, and which Shopify product each listing came from. It is in your twirlr data export.
9. What you may not sell, and takedown
You may not list:
- anything illegal, unsafe, recalled or counterfeit, or that copies someone else’s brand or design;
- anything that is not for dance;
- age-restricted goods;
- anything aimed at sexualising children or at making contact with a child;
- listings that mislead buyers about the item, its condition, its price or who is selling it.
We may remove a listing, pause or close a stall, or hold payouts if: an item is illegal, unsafe, recalled, counterfeit or prohibited; it is not for dance; a description misleads; reviews are fake or incentivised; your returns or complaints are unusually high; we suspect fraud; you break these terms; you are no longer based in the UK; or the law or an authority asks us to.
We pass on product safety recalls and notices to you, and where needed to your buyers.
If we take a listing off the Stall, for example after a report, we tell you and your team in the app and by email, with the reason and a reference. You cannot put it back on sale while it is down. To ask us to look again, email our safety team quoting the reference; a different person looks at it where we can, and we put it back if we got it wrong.
10. Reviews
- Buyers can review what they bought. Reviews must be real. Never offer anything for changing a review.
- Buyers can message you about their order from the app; you answer in the seller console. Keep it about the order, never ask a buyer to pay or talk outside twirlr, and never message a child.
- You must not review your own stall, ask friends or family to, pay or reward anyone for a review (including with a discount or a free item), reward only good reviews, or hide or try to get rid of honest bad ones.
- Fake and incentivised reviews are banned by the Digital Markets, Competition and Consumers Act 2024. We remove them, and may pause or close a stall that uses them.
- You can reply to a review once, in public, as your stall. You can change your reply for 24 hours after you post it; after that it stays as it is. A reply must follow the community guidelines: be polite, never share the buyer’s details, and never ask them to change or remove their review.
11. twirlr’s role and our responsibilities
- We run the marketplace: the listing pages, the checkout, and the order, return and contact screens in the app.
- We are responsible for our own wording, and for our own bugs and failures, such as a fault in twirlr’s checkout.
- We remove illegal, unsafe or counterfeit listings and fake or incentivised reviews when we find them or they are reported, and we meet our duties under the Online Safety Act 2023 for listings and reviews.
- We pass on product safety recalls and notices.
- twirlr staff do not run your orders. They step in on an order only for safety or fraud, and every time they do is recorded in an audit log.
- Buyers contact you from the order (Contact seller). For private sellers, and for anything about twirlr itself (the app, a payment, a safety worry, a fake review), buyers contact twirlr from Help in the app.
- Under 16s cannot buy on the Stall. They can browse and use Ask a grown-up, so a parent can buy for them.
12. Covering our costs
You will cover twirlr’s reasonable losses and costs (including claims by buyers or others, fines and chargebacks) that arise because of your listings, the products you sell, or your breaking these terms or the law. This does not apply to the extent the loss was caused by twirlr’s own fault. We will tell you promptly about any claim and take reasonable steps to keep the cost down.
13. Liability
- twirlr is not the seller and is not responsible for the goods you sell, their quality, safety or delivery, or for what you say about them.
- Neither of us is liable to the other for loss of profit, revenue or goodwill, or for indirect or consequential loss.
- Otherwise twirlr’s total liability to you in any 12 months is limited to the greater of the fees you paid twirlr in those 12 months and £1,000.
- Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow to be limited. If you are a private seller, nothing here takes away your legal rights as a consumer.
14. Suspension, ending, changes and complaints
- You can close your stall at any time in Stall settings, once your open orders, returns and disputes are dealt with.
- If we restrict, pause or close your stall, or hold your money, we tell you why. To end these terms with you, we give at least 30 days’ notice, unless you have seriously broken them, the law requires us to act at once, or buyers or children are at risk.
- Changes: we tell you about changes to these terms in the app or by email. A change that leaves you worse off takes effect at least 15 days after we tell you (longer if it needs more work from you), unless the law or safety requires sooner. If you do not agree, you can close your stall before it takes effect.
- Complaints: if you are unhappy with a decision or with how we treat you, contact twirlr support from Help in the app or at privacy@twirlr.app. We look into it and reply with our answer and the reasons for it.
15. Accepting these terms
You accept these terms in the app before your stall can be approved; we cannot approve a stall without it. We record the version you accepted (this version is 2026-10-30) and the time you accepted it. When the terms change, we ask you to accept the new version.
16. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales decide disputes. If you are a private seller living in Scotland or Northern Ireland, you can also use the courts there.
